Judges retire to decide Nine verdict

Three Court of Appeal judges have now retired to consider a decision in the appeal against Underbelly’s ban in Victoria.

Ron Merkel, QC, for Nine, has argued that Nine should be be allowed to show the first three episodes this month, saying the beginning of the series provided “background and atmosphere” and did not depict events that could prejudice the upcoming trial.

A judgement will be handed down at a date to be set. The trial in question is set to start on March 31st.

Should the verdict prove in Nine’s favour, it has to be asked, what would be achieved by showing only the first few episodes? 3 weeks of ratings won? Perhaps Nine is used to having its viewers given the run around with programming. At least this time it isn’t their doing…

    If they win this and get to air 3 episodes this month they will fall within 2 non-ratings weeks over easter. They’d be better off airing them the first 3 weeks of April!
