Seven loses first round to Corby

The Seven Network has failed in its bid to force the sister of convicted drug smuggler Schapelle Corby to pay a deposit as surety in their legal battle.

Seven last week applied for Mercedes Corby to pay “a moderate” sum around $100,000 to the NSW Supreme Court as security for costs. The cash would have been available to Seven if Ms Corby lost her defamation suit and was ordered to pay the network’s legal costs.

Lawyers for Corby argued it comprised delaying tactics to prevent the case proceeding.

Corby is suing the network, and other parties, claiming Today Tonight defamed her in a series of segments broadcast in February last year.

Ms Corby claims a former family friend, Jodie Power, made defamatory allegations during an interview, for which she was allegedly paid $120,000.

Justice Lucy McCallum today dismissed Seven’s application and ordered it to pay Ms Corby’s costs from last week’s hearing.

The defamation case is expected to proceed next month.
