Lookout bitches.

Carson Kressley is "crashing the Big Brother closet."

That's the title of a special episode that TEN has just announced for the reality series. Presumably it means he will go into house for some sort of makeover that will conveniently plug How to Look Good Naked at the same time -but who knows?

The one hour special is slated for 7:30pm next Wednesday following the Daily show.

As a result Rules of Engagement and Back to You are off air for the week, that's twice in a row for the Kelsey Grammer sitcom.

On Wednesday 21st May there is a 1 hr 7pm edition followed by Back To You. No Rules that week people. Go and complain to the diary room.

Nine wins appeal against IceTV

The Nine Network has won an appeal in a copyright case against IceTV.

Nine claims that IceTV’s electronic program guide (EPG) infringed copyright in its television schedule by creating its own “independent compilation”.

IceTV initially won the case in August 2007 against Channel Nine.

Yesterday the Federal Court allowed Nine’s appeal, noting copyright over time and title of Nine guides. It found "Ice reproduced a substantial part of Nine’s copyright work. The required causal connection was present. This was a case of indirect copying of a substantial part of a copyright work."

Ice must pay Nine's appeal costs.

Most industry observers speculate that Nine has vigorously fought this action to diminish the power of viewers effectively building their own programming, recording and skipping shows via EPGs -a significant threat to advertising revenue.

But all is not over. The matter is referred back to the original judge, Justice Bennett for further hearing.

"We will vigourously argue our case before the courts," says IceTV's manager Matt Kossatz, "including if necessary to seek special leave to appeal to the High Court. Subject to digesting the Full Court’s judgment it is business as usual. We will be meeting with our legal team in preparation for the next round."

IceTV’s Chairman, Mr. Colin O’Brien added, “The battle is far from over and we are still convinced that when we demonstrate our true business methodology we will prevail.”

Interview: Jason Stephens

When The Choir of Hard Knocks won a Logie as Most Outstanding Factual Series the voice over boomed, “Accepting the award is the show’s creator and presenter, Jonathon Welch!”

Except, that didn’t quite give viewers the full picture. What was that guy from the D-Generation doing there beside him?

Jason Stephens, who conceived the ABC series, has long put his performing days behind him, preferring to work creatively in production. His CV is quickly becoming dotted with projects that are heaped with praise. The King. The Choir of Hard Knocks. Newstopia. In our relatively small industry, that’s tantamount to ‘hitmaker’ status. He spoke to TV Tonight about his rise to glory, with two of his projects scoring wins at the Logie Awards.

“We’d won a couple of ASTRAs and some AFIs, so I was quietly confident (The King) was going to do ok,” he said. “But you go to those nights thinking it’s a bit of a lottery. I was particularly happy for Stephen (Curry) because he’d worked so hard and I think, all kudos to him because he gave such a great performance. And at the end of the day the whole film rested on his performance. There was a fair bit of pressure that went with it as well.”

Stephens is now Director of Development with FremantleMedia –a cushy title if ever there was one. He is given the envious task of overseeing a small team constantly looking at new formats that will be pitched to networks, and should they become hits, franchised internationally. In such a role, he doesn’t miss the on-screen days of the Late Show, preferring a vehicle that facilitates his passion: new ideas.

The D Generation was always working on fresh ideas and having them to go air nationally each week. Now that I think about it I was always writing comedy scripts and thinking ‘gee who could play this?’ as opposed to thinking I was writing for myself. I guess that was a bit of a clue that performing wasn’t the number one priority for me.

“When I meet people who want to do stand up or want to be actors the ones who are driven, who kind of get there are really committed. I was never that sort of driven. Unless you’re passionate about those kinds of things you’ll quickly fall off.”

On Sunday Stephens stepped back into the spotlight, albeit momentarily, for due praise in creating the Choir of Hard Knocks. Choirmaster Jonathon Welch has traditionally been ‘the face’ of the hit show, a function that has served the project well. Despite it being Stephens’ concept, he remains comfortable with the media focus on Welch. It was something of a ‘win / win.’

“In terms of making the show we made a decision, not even a conscious decision. It was never going to make good TV to talk about where the idea came from. You don’t really want to put that television construct in the storytelling. It kind of gets in the way.

“So we said, y’know, Jonathon started up his own choir -which he did really. But we didn’t talk about the couple of stages before that which were me tracking him down. He’d already done it before in Sydney on a smaller scale about 4 or 5 years ago. But I tracked him down and said ‘I’ve read about this homeless choir in Montreal, and know you’ve done the same thing in Sydney and said would you like to it again in Melbourne on a much bigger scale with real support?’”

Now the show is being considered by a number of territories including France, Denmark, Germany and New Zealand.

This year Stephens has been busy with two projects, Newstopia for SBS and the upcoming Comedy Slapdown for the Comedy Channel.

After its second series, he is comfortable with where Newstopia is sitting and acknowledges the positives and negatives of not being in the spotlight of prime-time commercial television.

“We’d like to have more people watching it,” he concedes. “I feel like it’s a strong show but the problem has always been it’s ‘Off Broadway’ on SBS. It’s a network that doesn’t always attract a lot of people by the nature of it, but there’s advantages to that too.

“We’re given complete creative freedom and the show’s allowed to organically grow, as opposed to having the pressure of being on a commercial network. In an earlier timeslot the pressure’s on so I guess you can’t have it both ways.”

Stephens is in discussion with SBS about a third season of Newstopia hopefully eyeing September or thereafter.

“I think they’re really happy with the show. It’s been good for both sides.”

Comedy Slapdown meanwhile is another original format, bringing together 17 comedians, in theatresports-style rounds set in a wrestling ring. Comedians including Tom Gleeson, Julia Zemiro, Stephen Hall and Matt Tilley will comprise 5 teams of 3 round robin competition over 12 eps. It is hosted by H.G. Nelson.

It’s all part of a role that sees him oversee a number of genres. Busy boy.

“In terms of drama I’m developing a couple of different projects. And then there’s light entertainment, and then factual shows. So we’re across about three or four different genres and always working them up at various stages of development.

“Personally I’d love to do another drama off the back of The King. But I think in terms of the company’s sake it would be great to have a long running variety / light entertainment show, which I think everybody’s after.”

With his ninety-seconds of award glory for the Choir of Hard Knocks over, Stephens is back to the business of finding the next hit format.

“It was nice. It was good to get up there with (Jonathan). I’d been living with it a year even before I pitched it.

"The Logie for that was liberating in a way just to put it behind me and move on.”


TV1 will re-screen Stephen Curry's Logie-winning performance as The King this Sunday at 8:30pm.

Australian Story's show of force

Move over Hamish and Andy.

Monday's Australian Story will present the first of a two-part story in which a number of Aussie entertainers travel to Iraq and Afghanistan to entertain the troops.


General Peter Cosgrove will introduce the documentary which sees Angry Anderson, Tania Zaietta, Ami Williamson and others in Baghdad, Kabul and Kandahar.

In the second ep, they travel the Route Irish in Baghdad, where six people are killed the same day. They will also be seen having a spot of golf on the top floor balcony of one of Saddam Hussein’s bombed out palaces.

The final gig is a farewell concert for Australian troops who will be pulled out of Iraq in June. Everyone belts out the unofficial anthem of the defence force, The Angel’s Will I Ever See Your Face Again? to the Iraqi sky.

Airdate: Crime Investigation Australia

Another of the excellent locally-produced docos from Crime Investigation Australia is coming, this time revisiting the 1980s murder of a New South Wales’ teenager in Headless Body – The Kim Barry Story.

In 1981, the body of a young teenage girl was found dumped in bushland beneath a mountain lookout near Wollongong, south of Sydney. The head and fingers had been removed to prevent identification and the girl’s own bra and blouse had been used to tie her hands and feet.

The Steve Liebmann-hosted series will feature interviews with chief investigator, Keith Smith, the case’s leading senior detectives and Kim’s father, Brian Barry.

The world premiere episode will screen at 7:30pm May 29 on Crime & Investigation Channel.

No motive has ever been established for the killing and the convicted killer local miner, Graham Potter, who was released in 1996 after serving 15 years, still proclaims his innocence.

When the clothing was displayed on the evening news, the victim’s distraught mother recognised them and the body was soon identified as that of Kim Narelle Barry, a 19-year-old local shop assistant.

Kim’s head and fingers were later found in scrub some distance from the lookout. Damage to the skull showed she had been bludgeoned to death.

It was a classic murder mystery.

A national manhunt culminated in the arrest of local miner, Graham Potter.

Despite his protests of innocence, and claims that two thugs had actually killed her, Potter was convicted of Kim Barry’s murder and sentenced to life imprisonment.

No motive has ever been established for the killing and Potter, who was released in 1996 after serving 15 years, still proclaims his innocence.

Aussie soap out of the race

Major news today from the UK with BBC1 dropping Aussie-made soap Out of the Blue after just six episodes. That's nearly as bad as Canal Road.

The remainder of the 130x30' run will air on BBC2 in a 13.00 slot from May 19.


Last week there was much hype over the strong debut for the series but ratings tumbled from 1.2 million for its April 28 debut to just 655,000 a week later.

"Out of the Blue is a bold and original commission for BBC daytime with its compelling mix of human drama and its intriguing murder mystery set in a stunning location," a BBC spokesman said. "The afternoon slot on BBC One, which the series had been in, is very competitive and by moving the show to BBC Two, we hope it will find a stronger home."

The future for the TEN Network must surely mean it is now off the table too? TV Tonight hears it was slated for a 6pm lead-in to Neighbours, the show it was made to replace in the UK. TEN would still get local quota points by running it (and frankly they need those), but now it is likely everyone will be re-thinking their position.

Disappointingly it will be replaced in the UK by the old Dick Van Dyke series Diagnosis Murder.

Start the timeclock on how long it takes local media to pick up this story, guys.

First Review: Flight of the Conchords

Who doesn’t love a good gag about New Zealand?

It’s the accents, the sheep, Helen Clark, the bloke who was ‘raped’ by a wombat, the perception that it’s stuck in the ‘70s and the fact that it’s far away enough to allow us to feel superior.


So the last thing I expected was two New Zealanders actually taking the piss first. No fair!

But that’s exactly what comedians Jermaine Clement and Bret McKenzie do as Flight of the Conchords.

The two singer-guitarists are already well-travelled performers, working the comedy circuit from Melbourne to Edinburgh. Their self-deprecating humour sits comfortably alongside ‘university’ humour of cool comics like Tripod.

They quickly endear themselves as lovable losers, and it’s this tone that has been transported into an offbeat, narrative comedy produced by none other than HBO.


The plot of their self-titled comedy series sees these two out-of-work musos trying to crack the big time in New York. They share an apartment while writing songs, busking, trying to hold down part time jobs, win girlfriends and haggling with their vacuous manager Murray (Rhys Darby).

Murray has aspirations bigger than his capacity. He works in a rundown New Zealand consulate office, walled by brown wood panelling that looks like something straight out of The Castle. Posters of mountains and The Lord of the Rings on the wall look down on band meetings where nothing is ever achieved or inspired.

Like the comedy of Ricky Gervais, this is understated humour sans laugh track or multicam. It also draws upon the boys’ considerable musical talents: they break into song at any given moment. Their music is a mix of folk and rock, peppered with lots of wry lyrics (“I’m sitting at this table called love/Staring down at the irony of life/How come we’ve reached this fork in the road/And yet it cuts like a knife?”) while other numbers are parodies of other artists (wait til’ you see ‘West End Girls’ reinvented in the second episode).

Arj Barker is a regular as a pawn shop employee, and comedienne Kristen Schaal steals the show as the boys’ slightly demented number one fan.

I’m hoping TEN’s audience won’t be too thrown by the unconventional storytelling and breakout songs (Viva Laughlin anyone?) which is actually the reason the show has some genuine originality.
