Nine loses ACA defamation case
The Nine Network has lost a defamation case brought against it by a Sydney surgeon following a report on A Curent Affair in August 2008.
Plastic surgeon and burns specialist Peter Anthony Haertsch sued Nine over a story on a Gold Coast ‘meter maid’ whose breast implants went horribly wrong.
A four-person jury found against the story when it wrongly depicted him as a “monster.” ACA also incorrectly alleged Dr Haertsch had been banned from practising in Queensland.
The jury found in his favour on five claims, including that he was not a “disgraced” doctor.
Justice Nicholas will continue hearing submissions on damages today.
Haertsch’s case was represented by Stuart Littlemore, who successfully defended Mercedes Corby against the Seven Network.
Last month Nine settled a defamation case brought against it follow remarks directed to a female AFL club director on The Footy Show.
