The fine print on X Factor contracts

Contestants must agree to having their voices dubbed in any language and performances exploited "throughout the Universe."

2013-09-17_0019Fairfax Media has published some details of contracts FremantleMedia has with X Factor contestants.

While Reality TV contracts are always comprehensive, they provide a fascinating insight.

Included in the 66 clauses are some of the following stipulations:

X Factor can use vision of their performance ‘in perpetuity’.
– contestants must agree to X Factor dubbing their voices in any language.
X Factor can also use personal information about X Factor contestants, including photographs, likenesses and biographical information, and transmit those personal details ”throughout the Universe”.
– ”I hereby licence to the company all rights in the composition(s) for the full period of copyright including any renewals, reversions, revivals or extensions throughout the universe…in all media and formats throughout the Universe.”
– their performances can be used, as well as passed to others, to exploit by all means and in all media formats, ”whether now known or hereafter invented throughout the Universe.”
– contestants also agree to promote the show without pay for one month after it finishes screening.
– they must not speak to the media without permission.
– they must disclose any criminal offences they have committed, except driving infractions;
– must not perform on any other TV or radio shows without permission.

US record label Camp West Recorders is pursuing a legal case after 2012 champ Samantha Jade signed with Sony Music.
